Contract Contract Step 1 of 3 33% Name ID Signature TERMS AND CONDITIONS STORE SECURE PTY (LTD) SELF SERVICE STORAGE AGREEMENT WHEREAS Store Secure Pty (Ltd) is in business of leasing storage space to the use of private individuals and/or registered entity. AND WHEREAS it is the desire of the undersigned Lessee to rent the said leased premises. NOW THEREFORE THESE PRESENT WITNESS: That on the date as shown on page 1 hereof, this Self Service Storage Agreement ("agreement") is made and entered into and between Store Secure Pty (Ltd), hereinafter referred to as the Lessor and the Lessee as set out in clauses A and B of this agreement ("Lessee"). 1. DEFINITIONS 1.1 “The Lessor” is Store Secure Pty (Ltd) of 30 Old Paardevlei Road, The Interchange, Somerset West, 7130. Phone: 021- 851 1066; Fax: 086 693 4300; Email: somersetmall@storesecure.co.za. 1.2 “The Lessee” is as set out in clauses A and B on page 1 of this agreement. 1.3 “The leased premises” is/are unit number/s as shown in clause D1 of this agreement which correspond with the unit numbers on the premises of the Lessor. 2. LEASED PREMISES In consideration of and subject to the terms and conditions hereinafter set out, the Lessor hereby leases unit number/s as set out in clause D1 of this agreement to the Lessee. 3. CONTENTS OF STORED GOODS Storage of dangerous materials, animals, fresh produce, goods which may cause nuisance to the Lessor in any way, illegal goods, explosives and any other hazardous material of whatever nature in or around the rented space is specifically prohibited. The Lessee warrants that the description of the goods stored on the leased premises as set out in Clause E8 of this agreement is true and correct. 4. ACCESS AND USE OF PREMISES 4.1 The Lessee shall limit his access and use the leased premises for the purpose of only the storage and the removal or preparing of an inventory of the contents of the storage units. These units shall not be used as a business, for manufacturing of any sort or as a residence, nor shall the Lessee loiter about on the premises. 4.2 The Lessee shall have access to the leased premises, provided that the Lessee has complied with all the terms and conditions hereof, on weekdays during normal business hours i.e. between 8:00am and 5:00pm, Saturdays between 8:00am and 5:00pm and Sundays between 9:00am and 1:00pm The facility will be closed on Sundays and public holidays, unless alternative arrangements are made between the parties. 4.3 Access to the leased premises and/or the storage facility may be refused, in the event of a breach by the Lessee of the security protocol, arrear rental or charges, due in terms of this agreement and/or disputed cancellation. The Lessee acknowledges the Lessor's right to remain in possession to protect its lien over the stored goods and to lock out the Lessee, until full payment or arrear rentals is received. 4.4 The Lessee shall keep and maintain the interior of the leased premises in good order and condition at the Lessee’s own cost and shall not store any object, which may cause damage thereto. 4.5 The Lessee undertakes to keep the area in the immediate vicinity of the leased premises in a clean and tidy condition, by ensuring that all waste, residual material and/or abandoned goods are placed in the area set out for this purpose. This obligation shall be binding on the Lessee at the commencement of the lease, for the duration of the lease and shall also apply to the Lessee while it is in the process of vacating the premises. 4.6 The Lessee shall, on demand, allow the Lessor or the Lessors’ agent, to inspect the contents of the leased premises for the purpose of ensuring compliance with this clause. DEPOSIT 5.1 The Lessee shall pay a deposit, if requested by Lessor, in advance, of the amount as set out in E4 of this agreement. 5.2 The deposit will be forfeited should: 5.2.1 The leased premises not be returned to the Lessor at the termination of this agreement in the same condition as received. 5.2.2 The Lessee fail to pay any part of the rental amount. 5.3 The deposit less any charges in terms of this agreement shall be returned to the Lessee within 2 weeks after the termination of the agreement. In the event of repairs of charges exceeding the deposit, the Lessee aggresses to compensate the Lessor, within 30 (thirty days) for the amount of any damage, in excess of the deposit, upon receipt of notice of such amount. RENTAL AMOUNT 6.1 The Lessee shall pay a monthly rental, in advance, on or before the first day of each month, to the Lessor. 6.2 If the commencement date falls before the 15th of the month, a full month's rental will be due and payable. If it, however, falls after the 15th, a pro rata payment of 50% must be paid, in addition to a full payment of the first month’s rental. 6.3 Notwithstanding the date of signature of this agreement, the Lessee confirms and agrees that he is aware of the annual increase of 10% (ten percent), which will be affected annually on the 1st of June. 7. DURATION OF LEASE Irrespective of the date of signature by the parties hereto, the lease shall commence on the date, as set out in clause D2 of this agreement and terminate, by written notice, in terms of Clause 8 hereof, after expiry of the "initial period" as stipulated in D3. In the absence of express notice from either party, this lease agreement will automatically extend on a monthly basis, after the initial period, on the same terms and conditions as contained herein. 8. TERMINATION 8.1 This agreement may be terminated, by either party, by giving the other party 20 (twenty) working days written notice of termination. 8.2 While this agreement may commence on a date other than the first day of any calendar month, it may be terminated by the Lessee only on the last day of any calendar month.
